Express Entry

The Federal Skilled Worker Program is for applicants who possess a high level of education and/or significant work experience that can be easily transferred to the Canadian labour market. The applicants must meet certain criteria to qualify for this category. The program uses a point system to assess candidates. This point system is not the same as the Comprehensive Ranking System used to rank candidates in Express Entry. In order to create a candidate profile and be assigned a score using the Comprehensive Ranking System, candidates must first qualify for either the Federal Skilled Worker, Federal Skilled Trades or Canadian Experience Class. The points for the Federal Skilled Worker Program are a minimum requirement in order to be eligible to participate in Express Entry.

Prospective Applicants must obtain 67 points in order to qualify for the Federal Skilled Worker Program. Points are assigned in accordance with six factors, per below:

  • Education (maximum 25 points
  • Language Ability (maximum 24+4 points)
  • Work Experience (maximum 15 points
  • Age (maximum 12 points)
  • Arranged Employment in Canada (maximum 10 points)
  • Adaptability (maximum 10 points)

Start Up Visa Program

Canada’s Start-up Visa Program targets immigrant entrepreneurs with the skills and potential to build businesses in Canada that:

  • are innovative.
  • can create jobs for Canadians.
  • can compete on a global scale.

Eligibility:

  • have a qualifying business.
  • get a letter of support from a designated organization.
  • meet the language requirements.
  • bring enough money to settle.

The program requires a minimum investment of 235000 CAD (Canadian Dollars) over a period in designated businesses approved by the Canadian government. The purpose of the program is to recruit innovative entrepreneurs to the country by linking them with Canadian angel investor groups, venture capital funds or business incubators to facilitate the establishment of their start-up business in Canada.

Provincial Nominee Program

The provincial nominee program is a designated program run by the various provinces in Canada which allows provinces to invite applicants to fill up their immigration needs based on economics, occupational demand etc.

This program is for workers who:

  • have the skills, education, and work experience to contribute to the economy of a specific province or territory.
  • want to live in that province, and
  • want to become permanent residents of Canada.

Each province and territory have its own “streams” (immigration programs that target certain groups) and requirements. For example, in a program stream, provinces and territories may target:

  • students
  • businesspeople
  • skilled workers
  • semi-skilled workers

Quebec Based Program

This is the application process for skilled workers who want to become permanent residents of Canada and live in Quebec.

Quebec has a special agreement on immigration with the Government of Canada. The province has its own rules for choosing immigrants who will adapt well to living there.

To immigrate to Canada as a Quebec-selected skilled worker, you must apply in the following 2 stages:

  1. Apply to the Government of Quebec for a Quebec Selection Certificate Certificat de sélection du Québec [CSQ].
    • The Province of Quebec will assess you, using its own rules.
    • The certificate shows that the Province of Quebec has accepted you as an immigrant.
  2. If the Province of Quebec chooses you and gives you a CSQ, you must apply to Immigration, Refugees and Citizenship Canada for permanent residence.

Work Permits/LMIA

Work permit is the document which authorizes nationals from certain group of countries to enter Canada to perform work, be employed for the duration which is mentioned on the visa.

Foreign nationals wanting to work in Canada are required to obtain a Work Permit. The foreign national may also require a Temporary Resident Visa should they wish to travel in and out of Canada. The requirement to obtain a Temporary Resident Visa will depend on the foreign national’s country of origin.

Should a foreign national who is already in Canada on a Temporary Resident Visa wish to commence employment in Canada, he or she must obtain a Work Permit from a Canadian Consulate, Embassy or High Commission abroad.

Self Employed Federal Class

The Self-employed Persons Program allows people to immigrate to Canada permanently as a self-employed person. Self Employed includes people from the creative and sporting field who have made substantial amount of contribution in their respective areas of profession and work. Some of the professions that qualify are:

  • Actors
  • Athletes
  • Jewelry Designers
  • Authors/Librarians
  • Producers, Directors
  • Musicians
  • Goldsmiths

These are some of the professions but there are many more in this. The individual needs to showcase in past 5 years that they have the relevant experience in their professions coupled with the documents.

International Mobility Program

The international mobility program is the business program for those Corporate’s who are looking at transferring internally the employees from outside Canada to in Canada. This program does not require to obtain a LMIA (Labour Market Impact Assessment). The employee hired under this process comes on a temporary status as a worker.

The employer files on behalf of the employee on the employer portal the offer of employment and post that the employee files for a work permit with IRCC Canada.

Employer as a usual process needs to mention complete details of the job the nature of employment being offered, minimum education requirement, wages and benefits offered if any. Failure to mention any of these can invite penalty being levied on the organisation.

The information entered could be used in federal government employer compliance audits. Employers submitting a job offer with receive an offer of employment number. The foreign worker requires this number to complete their work permit application.
